All listings offered on Amplife® must comply with all international, federal, state, and local laws and regulations and with our Program Policies. The sale or advertisement of illegal, unsafe, or counterfeit listings is prohibited, and can also lead to legal action, including civil and criminal penalties.
If you offer inauthentic listings, we may immediately suspend and/or terminate your Amplife® account under Section 3(b) of the Amplife® Vendor Participation Agreement ("Agreement"), without a cure period. Sales proceeds are remitted on the schedule in the Sell with Amplife® Service Terms, under which an order's proceeds become eligible for remittance only after its Confirmed Delivery Date. If we determine that an Amplife® account has been used to sell inauthentic goods, commit fraud, or engage in other illegal activity, amounts arising from or associated with that activity may be withheld and, upon final determination, applied to customer redress, our damages, and our costs, with any remainder handled as required by applicable law. It is each vendor's responsibility to source, sell, and fulfill only authentic listings. Prohibited listings include:
bootlegs, fakes, or pirated copies of listings or content; and
listings that have been illegally replicated, reproduced, or manufactured; and listings that infringe on another party's intellectual property rights.
We may remove suspected listings based on our review of listings. We also work with rights holders and law enforcement worldwide to take and support legal action against vendors who knowingly violate this policy and harm our customers. Under Section 18 of the Agreement, Amplife® may bring claims related to your sale of counterfeit products on the Amplife® Site in the Governing Court (the Superior Court of California, County of Contra Costa) and seek any remedy available under law. In addition to criminal fines and imprisonment, vendors of inauthentic listings may face civil penalties including the loss of any amounts received from the sale or advertisement of inauthentic listings, the damage or harm sustained by the rights holders, statutory and other damages, and attorney's fees.
As described in Section 1 of the Agreement, you must provide, and annually certify or update, the identity, bank-account, tax, and contact information we request under the INFORM Consumers Act (15 U.S.C. § 45f), and you consent to our collection, verification, and, where required by law, disclosure to customers of required seller-identity information. Vendors that fail to provide or certify this information within 10 days of our notice will be suspended as required by law.
To help keep the shopping experience trustworthy for our customers, by selling or advertising on Amplife®, you agree that:
The sale or advertisement of counterfeit listings is strictly prohibited;
You may not sell or advertise any listings that are not legal for sale, such as listings that have been illegally replicated, reproduced, or manufactured; and
You must provide records about the authenticity of your listings if Amplife® requests that documentation.
Failure to abide by this policy may result in funds being withheld as described above, suspension and/or termination of your Amplife® account, and other legal consequences.
This policy is a Program Policy under the Agreement. If anything in this policy conflicts with the Agreement or the applicable Service Terms, the Agreement and Service Terms control.
