The Trademark Usage Guidelines ("Guidelines") apply to your use of the Amplife® name and the "Available at Amplife®" badge (the "Badge"). The Amplife® name, the Amplife logo, the Badge, and Amplife®'s other trademarks (together, the "Marks") are owned solely by AMPLIFE LLC.
These Guidelines are a Program Policy under the Amplife® Vendor Participation Agreement ("Agreement") and the Sell with Amplife® Service Terms ("Sell with Amplife®"), and these Guidelines are part of the Amplife® Vendor Program ("Program"), but, unless specifically provided otherwise, concern and apply only to your use of the Marks. If anything in these Guidelines conflicts with the Agreement or the Service Terms, the Agreement and Service Terms control.
No Approval Needed: Saying You Sell on Amplife®
Under Section 11.3 of the Agreement, you do not need prior approval from Amplife® to:
Accurately state that you sell on Amplife®, for example, "We sell on Amplife®" or "Our products are available at amplife.co"; and
Use the plain-text Amplife® name and the Badge in accordance with these Guidelines to advertise that your listings are available on an Amplife® website.
If you comply with these Guidelines, you do not need any further approval from Amplife® for these uses.
Advance Written Permission Required
The following always require advance written permission from Amplife® (contact [email protected]):
Press releases;
Co-branded campaigns; and
Any statement or material that states or implies a partnership with, or sponsorship or endorsement by, Amplife®.
You must not use the Amplife logo or any other Amplife® trademark, other than the plain-text Amplife® name and the Badge as permitted by these Guidelines, in your online or offline marketing materials (including listings on Amplife® websites) unless you have written permission from Amplife®.
You will not misrepresent or embellish the relationship between you and Amplife®. Amplife® may require you to promptly correct or remove any inaccurate, misleading, or non-compliant statement or material, and you will do so promptly.
Proper Form for the Amplife® Name
Spell the name exactly as "Amplife" with a capital A, and include the ® symbol on the first or most prominent use, for example, "Amplife®". Do not abbreviate, hyphenate, translate, or misspell the name.
Use the name as a brand name (for example, "available on Amplife®"), never as a verb or in the possessive form.
Do not combine the name with your own names or marks, and do not use it in or as any part of your business name, product name, domain name, social media handle, or app name.
Do not use anything confusingly similar to the Amplife® name or any other Mark.
Include the following attribution statement in and on any materials that display the Badge or make more than incidental use of the Amplife® name (online or offline): "Amplife and the Amplife logo are trademarks of AMPLIFE LLC, registered in the U.S."
Badge Requirements
You are allowed to use the Badge only to advertise the availability of your listings on Amplife®. You must use the Badge only:
On your website; and/or
In online advertisements; and/or
In offline advertisements.
You must link the Badge to a listing on Amplife® if it's not an offline advertisement.
You must use the Badge solely for the purpose expressly authorized by Amplife® in these Guidelines, and your use must:
Comply with the most up-to-date version of these Guidelines; and
Comply with any other terms, conditions, or policies that Amplife® may issue from time to time that apply to the use of the Badge.
You must not alter the Badge in any manner, including but not limited to, changing the proportion, color, or font of the Badge, or adding or removing any element(s) to or from the Badge.
The Badge must appear in its entirety, with reasonable spacing between each side of the Badge and other visual, graphic, or textual elements. The Badge must not be placed on any background that interferes with the readability or display of the Badge.
You must not use the Badge as part of a sentence, such as, "Our listings are (Badge), so please shop online."
You must not use the Badge in any manner that implies sponsorship or endorsement by Amplife®, other than by using the Badge as specifically authorized in these Guidelines.
You must not use the Badge or any other Marks to disparage Amplife®, its listings or services, or in a manner that, in our sole discretion, may diminish or otherwise damage Amplife®.
Other than the plain-text Amplife® name and the Badge as permitted by these Guidelines, Content must not include any Amplife® logos or other trademarks, variations, modifications, or anything confusingly similar to Amplife® logos and other trademarks, unless otherwise approved in writing.
You must include the attribution statement set out in "Proper Form for the Amplife® Name" in and on any materials that display the Badge (online or offline).
You acknowledge that all rights to the Badge, and all other Marks, are the exclusive property of Amplife®, and all goodwill generated through your use of the Badge or the Amplife® name will inure solely to the benefit of Amplife®. You will not take any action that conflicts with our rights in, or ownership of, the Marks.
Compliance with these Guidelines is required at all times, and any use of the Marks in violation of these Guidelines will automatically terminate the license related to that use. Amplife® may modify these Guidelines and/or the approved Badge in accordance with Section 15 of the Agreement, and may take appropriate action against any use without permission or any use that does not comply with these Guidelines.
